Legal Question in Consumer Law in Texas

usury law in texas

my husband was taken to small claims court on the usury law. on a business investment he had made. the judge found in his favor. he was out of town & i stood in his stead. Now, the case has been appealled to a higher county court. I've been told the usury law has ''teeth'' Can i have them wait on this til he is back in town or do i have to stand in his stead again.

Re: usury law in texas

In County Court he has to appear personally or by an attorney, a non attorney could not appear..and in County court you must put any defense in writing signed by HIM or an attorney..if the case could be large, hire an attorney..you may have a claim against the other side...but you give too few facts for a good answer
