Vehicle Title

Hello, I have the title to my vehicle, signed off as the lien holder by Ford Credit. Ford Credit is claiming that I still owe them money and they have even sent a repo guy to harras me. First Ford Credit said there was no way I had the title and that I must have made a mistake, because if I did have the title that would prove I own the car.

The repo guy called me and threatened me: warrant for my arrest, I better not go any where he will follow and take my car, I better meet up with him and he even claimed to be with the Sherif's department.

Now they realize that I really do have the title. Ford says they will call off the repo guy only if I agree to return the title. Why in the world would I do that? What are my rights for the illegal activites in which Ford Credit has authorized and is completely aware of. Do I file with the Texas Attorney Generals Office and what can I do to prevent them from taking my car?

Have you fully paid Ford Credit for the vehicle, or did they screw up in sending you the title? If you have fully paid, then let them know (both telephone and certified mail, return receipt requested) that if the vehicle is repo'd you will sue them for conversion and punitive damages as well as the value of the vehicle.

If you think you've paid, but aren't absolutely sure, demand a final accounting and then pay the balance if any.

If you owe them, pay them. And tell them that their repo man has violated the Fair Debt Collection Practices Act by threatening to have you arrested, and Ford Credit is responsible for his action.
