Verbal contract on vehicle sale

A neighbor was selling a car & I asked him if it needed a head job and if it would pass the emissions inspection. He said ''no, it didn't need a head job and it would pass the emissions testing'' and with this assurance I bought the car, but it turned out it did need a head job. I want my $1200 dollars back + the $200 I spent on parts such as tires and brakes. I told my roommate before I bought the car that the neighbor said that it didn't need a head job and that all it needed was to be driven. However, after $200 worth of parts and many hours of tune-up, changing tires, etc. I took it to a mechanic who said that it did need a head job. Will this hold up in small claims court. The guy was selling the car for his son. The title and bill or sale is in the son's name but the person that we gave the money to is the father.

If the judge accepts your evidence as proof by a preponderance of the evidence that the seller warranted the car, then you could prevail.
