Legal Question in Consumer Law in Texas

warranty enforcement

I hired a contractor to install wood floor in residence in

March 2006. Floor was not leveled before installation because contractor said that it was already level. Floor pops at certain points when stepped on and one spot was never flush with rest of floor. contractor has promised several times to come back and make repairs but never shows or calls.its been a full month and now contractor won't even return calls but has been paid in full. What legal recourse do I have if any? I have a business address for company from phone directory but not sure if it is valid. I do have the name of the representative of the company that I dealt with.

Re: warranty enforcement

The very first step is a letter, sent certified mail, demanding leveling of the flooring. If they fail to respond in a reasonable time, say 10 days, get quotes from other contractors in the business as to the cost of remediation.

If under $5,000.00, you can pursue a claim for the cost of repairs in Small Claims.
