Legal Question in Consumer Law in Texas

Hello. Me and my wife enrolled our kid in a Daycare. He is 13 months old, and this Daycare is supposed to be a "preschool and Academy" and only accept kid from 18 months, but they were supposedly going to make an exception. We did like the school at first but the enrollment fee they said it was $175.00 dlls."non-refundable" which we tough it was too high compare to other daycare's with an average of 25 to 50 dlls. We gave the check to save the spot and paid half of the tuition as well for the week. They gave us the application and agreement to fill out and returned on the next day leaving the baby.

The next day on his first day, we went at 7 am. and there was only a lady at the reception that did not have any idea of what was going on, apparently, she is the one that cooks to the kids. Everyone that went to drop their kids had a pass code, which we never got, also I couldn't give back the filled application and agreement in which included the agree on the 175 non-refundable dlls. We were so upset cause the lady did not wanted to take the baby with the other kids inside, instead she said she was going to wait in the front desk till the director came in and see what was going on. We did not left the baby there and called the director assistant at 9am. She apologize a lot, but when we said we wanted to cancel and wanted our money back, she refused and mention that the money was not refundable and the tuition was taking from 3 to 6 week to mail to my house. I alleged that I did not turn in the aplication signed agreed in the section of the enrollment fee, but she said that did not matter, so it was only on words.

Its been 3 weeks now and I have not received a single dime back. What can I do? Can I sue?

You can sue the daycare in JP court.
