Legal Question in Credit and Debt Law in Texas
3 yr.oldmedical bill
received a med. bill from 3 yrs.ago for lst time (2 mi ambulance ride for l400.00). I couldnt imagine what it was for since all medical bills had been paid and closed for years. after researching my records i remembered and found notes where i had begged for a itimized bill 5x and begged them to submit to my ins 5x. they did neither. this was lst i ever heard in 3 yrs and I still dont have an itemized statement. I have since changed ins. and the ins I had at the time has a time limitation on filing of course. What are my legal rights with this bill and what recourse do I have? Needless to say, I do not feel I owe it, but have always paid my bills and have excellent credit and dont want to risk having this reported . The ins. would have covered it if they had done their job as I requested 5 times and filed it! I know they never did because in my notes i wrote I had called ins. 5 or 6 times (i kept following up with calls to ins. months afterward)and they said they never received a claim and could not pay without a bill and claim. My hands were tied without a ins. claim or itemized statement with tax I.d. to submit myself.(according to ins.). I dont remember giving my S.S# yet they had it and certainly did not give my signature.

OPINION...your insurance is still responsible regardless of what their limitations state..and if they are not responsible, the provider who failed to submit is without recourse..Of course, the med provider can sue you in JP court..and you must answer and defend..but personally, I doubt if they will. Hence, watch your credit report to see if you have adverse comments and promptly dispute...
