Legal Question in Credit and Debt Law in Texas

Is it possible to get an abstract judgement debt reduced after they have sued you? I'm trying to sell my house and the judgement is there and My actual debt is only half of what the judgement is for, please help my closing is on 30 Oct, I live in Texas in Tarrant county. Thank You

If the creditor with the judgment will accept a lesser amount to satisfy the judgment and remove the lien on the property then sure you could have it reduced. However, that is voluntary on the part of the creditor. The creditor is entitled to recover the full amount of the judgment even if you believe you only owe part of the debt yourself. Your opportunity to challenge your obligation on the debt was at trial.

You also need to look at whether your house is exempt from the judgment. If the debt is not related to the house itself (such as a mortgage, mechanic's lien, or debt secured by a fixture in the home like a water heater) then it may not be collected against the sale of the house. However, the title company may not be willing to state the title is clear with any kind of abstract on the property.
