Legal Question in Credit and Debt Law in Texas

Affected by ex-husband's bad credit after divorce

First: I am writing for my fiancee, not myself. I hope this will not affect your participation, as time is critical. The problem is that her name is on an original mortgage from a previous marriage, in which she awarded him the house. Her ex has since the divorce has been in financial trouble and is in foreclosure now. His debts have now shown up on her credit report, and have essentially ruined her good standing. The credit bureaus are saying that they will not consider her divorce decree, although it states clearly that she is absolved from all debt prior to divorce. All his debts have come after the divorce, but she still gets no action. I hope you can help. Thank you.

Re: Affected by ex-husband's bad credit after divorce

Debts he incurred after divorce are his. However, the mortgage obligation is before the divorce and she's still on the hook for it. She can sue her ex, for what it's worth, on the divorce decree but that's not binding on the mortgage company.
