Agreed Judgment?
I am the one being sued by Capital One for 4000.00 plus 1200.00 in fees. I did what you said and called and said Im not going to agree to judgement and would pay in payments. The attorney said ok and said she would send me forms to sign. I just got them and the say'' agreed judgment''. It says the court has considered the pleadings and records on file in this case and the evidence and is of the opinion that judgement should be rendered for the Plaintiff. It says ''It is Ordered the Plaintiff shall have all writs of execution and other process necessary to enforce judgment''. I don't understand, it sounds as if they will get the judgment against me and it will be on my credit report. Is this what that sounds like to you? What should I say to them? Please help!!!

You still don't have to agree to it. Call and tell her you will not sign it and to send you something different.

you need to address your note to whoever advised you...my advice is to file an answer...do not trust phone calls...and now you do have the judgment on your credt..but you may have time to appeal..call a lawyer..
