Attempt of payment

Is it correct that if you make an attempt of payment to an outstanding debt that the company must accept the payment? Also, can a company try to press criminal charges if more than half of the original charges have been paid? They are citing Texas Penal Code Title #7 Sec. 31.04 Theft of Service, as the reason that they can. They have been reimbursed through my insurance company for 80% of the original charges. I would like to pay them; however, it took them nearly 2 years to provide an invoice for the balance due. I had requested it several times through phone conversations with them. Now I am unable to come up with one bulk payment for the remainder of the balance. Do they have to accept any amount of payment that I send as an attempt to pay the debt?

The creditor is not required to accept anything less than full payment.
