Legal Question in Credit and Debt Law in Texas
Attempts to collect debt
I have a roommate that has not paid a $8000 debt on a credt card. Her limit is $5000. An attorney called her and said they had filedcharges and she was going to jail if she does not pay half the amount owed. Is there a chance this is true or is it harassment?

Re: Attempts to collect debt
If this is a credit card debt, the attorney has just violated the Fair Debt Collection Practices Act. In the United States, you cannot be imprisoned for failure to pay a debt. Threatening someone with criminal consequences for a civil debt is a violation of the FDCPA.
