auto accident/can't get ins info from other party

yesterday my daughter and her sister and two little boys that they babysit were coming home from school. In the middle of town , a girl on a 4-wheeler ran a stop sign and slammed into the side of my daughters car, claiming it had no brakes. When I contacted her parents for insurance info, she got mad and asked why I cussed her daughter out ( which was a complete lie!) and hung up on me.

The man that owns the 4-wheeler said that he would get me his ins. info, but since then the girl has has told everybody that I cussed her out, no one will give me any info about insurance. I know we should have called the police, I regret that so much!!! Everybody was frantic and the two little boys were hollaring...I could really kick myself for not calling them. at the moment I am filling out a blue form the the police brought to my house last night. What are my other options here to get them to pay for these damages? It's about $5,000 to $6,000 in damage. We have full coverage ins. because its a new car, but I really dont think that we should have to pay for it! Any help would be greatly appreciated. Lisa

Perhaps the police can get the insurance information to complete their report. Otherwise, there is nothing you can do (short of filing a lawsuit) to get their insurance information. You can submit the claim to your insurance company, pay the deductible and let the insurance company go after the other party. In my experience, insurance companies try very hard to recoup these $5000 -$6000 claims and they will file a lawsuit against the offending party. Good Luck.

your insurer should get the info and collect from the owner or parent..AND should collect your deductible. Yes, when there is that much damage, call the police..don't try to be 'nice' to children, etc...
