Legal Question in Credit and Debt Law in Texas

Auto Finance

I am in Houston and due to Ike my car was totaled with an upside down balance of $5000. We have purchased another vehicle but the car dealership called and said we must pay off the $5000 or return the vehicle because we can't have three cars financed. What are our options? Can the new car actually be taken away? We have signed all contracts and put $4000 down.

without seeing the contract to finance the last car, I don't know but I would not return nor let them take..perhaps you could file in JP court for damages against the dealer and the finance company for misleading you....or just negotiate...good luck
