Legal Question in Credit and Debt Law in Texas

Bad Checks

I live in Austin, Texas and I was presented two checks from a tenant farm who lives in Coleman, Texas. The checks were presented to me at Closing when I sold the family farm. The checks were presented to me by my cousin who owned 50% of the family farm. The checks were made out to the Sidney's Estate and I am the Executor for my Unlce who had no family. The question is can I take this claim to the Small Claims Court in Austin, Texas since I live in Round Rock, Texas.

Small Claims only has jurisdiction up to $5,000.00. Venue for Small Claims is the county and precinct where the defendant resides, and that is mandatory. You'd have to sue your cousin where he lives, if the checks totaled less than $5,000.00.
