Legal Question in Credit and Debt Law in Texas
Can bank accounts be seized in Texas?
A judgment will soon be awarded against my wife for credit card debt. In Texas, wages and houses are considered exempt property from garnishment and leins. My question is about bank accounts. The judgement will be on my wifes credit card (my name is not on the account at all). We have a joint checking account. Can the checking account be seized by the creditor? If so, can I have my wife removed from the account so they cannot seize the account?

Although paychecks cannot be garnished -- a judgment can be executed against a bank account. If a judgment creditor is able to locate a bank account in your wife's name, then it can execute against it.
