Legal Question in Credit and Debt Law in Texas
Never sent a bill
I was in the hospital in July 2001. I gave all correct info and didn't have insurance. Within 30 says, I recieved 3 bills and made arraingments to pay them. 2 are paid and 1 is being paid.On 1-13-2003 I recieved a call from a collection agency saying I owed a bill. After some research, I found it was a bill that they had gotten the wrong address. They never called me and never cheched with the hospital to verify the address so I never had knowledge until the collection agency called me.It is 31 months after my hospital visit. It was thier fault through incompetence or neglegence. (The other 3 bills got the right info) Do I have any recourse? Any help would be great

Re: Never sent a bill
Is the bill otherwise valid? I.e., was it issued for services rendered or goods provided? If so, you are still liable for it and you should make arrangement for paying it. If the creditor is trying to collect for goods/services not provided to you or if the bills are otherwise invalid, you should provide evidence of such to the collector and request in writing that they no longer contact you.

If the bill is valid, even though sent to the wrong address, you are responsible for it. But contact the credit bureaus and ask that you be able to add an explanation to your credit report, stating that the reason the bill was sent to collection was because it was first sent to the wrong address. That way it should have a minimal impact on your credit.
