Legal Question in Credit and Debt Law in Texas

Billing Practices

My mother has been diagnosed with Alzheimer's dementia & is no longer competent to handle her financial affairs. Even though not legally obligated to do so, I have been paying her bills. One creditor refuses to discuss her account even though 2 separate consent forms have been signed & returned. I have not received a statement from them since Jan. 2000, but have made payments anyway. Since they refuse to send a statement or discuss her payments with me, what can they do to my mother if I don't send any more payments?

Re: Billing Practices

If the accounts are not paid, the creditor could file a lawsuit to collect the unpaid balance, court costs, expenses and attorneys fees. If a judgment is obtained and recorded, the creditor could collect upon the assets of your mother's estate if a proper claim is filed. Whether this would be cost effective for the creditor is another matter.
