Legal Question in Credit and Debt Law in Texas

Breach of Contract

My question is I took out a payday loan that was being deducted from my savings account. The account became overdrawn due to the fact that I could not reach the home company to stop the deductions and the saving account was recently closed. I received a call today that I will be arrested on my job or at my home if I do not come up with the balance in full today. The origanal loan was from Florida but I live in Texas is there any recourse that I may take to prevent the arrest or any other options I can take to try to clear this up if funds are not immediately available to me to pay this off?

Re: Breach of Contract

You can't be arrested for failure to pay a debt. Get the tape recorder out and tape the next phone call. Ask them on what basis you could be arrested. Contact a consumer protection lawyer in your area.
