Breaking a Private School Contract

We signed a contract to send our sons to private school. Contract does state withdrawal by May would result in 50% tuition refunded. We discussed with them in April we may not be able to come back. Tried to get hired on to school to help tuition costs. Then we spoke to them in May about it. Finally in Late June we told them we could not afford it. We encountered lots of runaround until finally sent to schoo's CPA. He said he would see what he could do. Never called us back despite 7 calls. Now, 2 days before school is to start they sent us an email stating if we did not pay if full, although the kids were unenrolled, that we would be sent to collections via their attorney. We have paid close to $1800.00 in tutition over the summer which we aren't fighitng but can't pay the rest. What happens? Will this ruin our credit? Will we be sued?

They may sue..but it sounds like ambiguity in contract and you could countersue...but see a lawyer/or try to negotiate..and get it in writing if you can..If sent to collections learn how to dispute creditors claims with credit reporting agencies..and learn that some collection tactics may violate the law....No easy answer..but tell the school to contact your lawyer..and get one now
