Legal Question in Credit and Debt Law in Texas

Car Reposession (HELP PLEASE)

My boyfriend's aunt took out a car loan to buy an avalanche for him everything under her name. My boyfriend handed it over to his dad who signed a notorized letter saying he would take charge. He decided he no longer wanted it & called the bank to pick it up. The bank took the truck back & auctioned it. According to his aunt the bank keeps threatening to take her residence away because they are asking for her to pay $10,000 because the auction price didnt cover what was needed. She wants my boyfriend to pay that money. According to her a police officer tried to arrest her because of this but instead gave her 20 days to pay. Does he or his aunt have to pay that if it was repo by the bank & auctioned by them? What is the next step? Can the bank threaten to take his aunts & his dad's residency?

Re: Car Reposession (HELP PLEASE)

His aunt needs a lawyer..and someone needs to review all documents she signed..police don't do that, bank has no right to anything but car..UNLESS more is involved..

Unless something is completely out of whack, no criminal charges should be filed. The aunt is responsible for the balance of the loan that your boyfriend stuck her with. She can sue him, for what that's worth.

The bank can't take any of their residencies.
