Legal Question in Credit and Debt Law in Texas

car reposession

My friend bought a car in California and moved to Texas; now she cannot make the payments. She would like to know if she should sign the voluntary reposession form the company wants her to sign or not; she is worried that she will lose her house and needs to know what HER legal rights are in the state of Texas.

Re: car reposession

The only way she could lose her house here in Texas is if she defaults on the mortgage, or for taxes, or for a federal student loan.

If she doesn't voluntarily give back the car, a repo company will take it, and she'll be responsible for the costs of repossession as well as the car note.
