card not activated

I applied for a VISA. The card came in the mail, approved, with the agreement statement: late fee charges, annual percentage rate, etc. No where on the agreement, did I read about a yearly membership charge. I haven't even activated the card/account yet and I've received a bill for $39. Yearly membership charge. My credit is good, and I refuse to pay membership charges. None of my other cards require that. Should I cut the card up and return it with the bill? Will this void the $39 charge?

Without reading through everything they've sent to you I can't give you a solid, legal answer. I would suggest you call them and ask if they'll waive the annual charge since none of your other cards has them. If they refuse, ask if they'll cancel the annual charge if you do not activate the card. If they refuse, cancel the account, destroy the card, pay the annual charge, and never deal with those people again.

Once the charge has been made, if they won't cancel it, failure to pay will reflect on your credit.
