Legal Question in Credit and Debt Law in Texas

We had a WAMU ( Providian) credit card- it was charged off. Someone bought the debt. He had contacted us to get a payment. He told us the only reason his client bought the debt was because we had our FICO come up a bit and we got caught up on our car notes. He knows we have a house with some equity and has been watching our finances closely. (How do they do that?) Anyway- he is giving us until Wednesday to come up with $2501 to settle the debt (we owe $5200) that I don�t have and can not borrow. If we don�t pay him on Wednesday he said he was going to file in court and he said he has 10 years to collect. Not to mention this debt becomes 4 years old at the end of the month so they are in a hurry to collect. How do the judgments work exactly? Can he take my tax rebate check (my husband calls it the Chinese money check) or any other tax returns or do I pay only if I sell something�.

He has to win to get a judgment..and if he gets a judgment, he has to do a lot to keep it for 10 years. When was your last payment on the debt? Hopefully it will be far enough back that debt is barred ..but don't let him scare you..he may have already violated fair debt collection act..so see a lawyer..
