Legal Question in Credit and Debt Law in Texas
cc lawsuit in Texas
I've been sued for a cc debt ,the sol hasn't expired yet. Last payment was 1-06. I tried to settle with the initial company; However, I never received anything in writing which I requested a number of times , and then they ended up selling the account to a junk collector and they have added lots of late payments and over the limit fees, interest , etc. I have disputed this debt twice with them and I can't afford to pay this debt. I have gone disabled . My name has been added to our home title, even though my SS doesn't pay for any mortgage. My kids and I get SSD. What other actions can they take? Can they sue my husband for this cc debt later, as his name wasn't on my old credit card and isn't on this lawsuit now. We have a joint account, I don't contribute to it...but, if the kids need something I have access to it. Can they garnish this account? I am planning to go to court, since I don't think I owe all this; However, I can't afford a lawyer. I've read a lot on the internet. Is it to late to ask for validation? I asked for '' verification '' a few months ago and they ignored me and filed suit. Is there a form that has all these requests listed that I can reference? Any other suggestions?

Re: cc lawsuit in Texas
If they get a judgment, they cannot take your home and furnishings, car and most exempt property which you can find on web..and if you have a bank account only in your name, they could garnish the account but if in the name of you and husband or others, they cannot...also..your spouse is not liable..so tell collector callers you can't pay and quit calling...they may be able to collect the claim if you win the lottery..good luck
