Charge Off Accounts

Can you please tell me the fact about charge off accounts on your credit record? I was under the impression that once there was a charge off listed, that you were no longer responsible for repayment. IE: 3 years ago during the divorce, my ex was to have paid of two credit card accounts. I am now being hounded by the collection agents and being told that they are going to prosecute me for the amount of charge off. Yes I was on the account as a second signature. One of these is a Providian Master card and the other is a Visa from a store that they closed here in town.

Am I legally bound to this charge off or can I tell them to stop calling me at work and at home?

"Chargeoff" is simply a bookkeeping entry so that they no longer carry your account as income. It doesn't clear the debt.

You and your ex are jointly and severally liable on the credit cards as community debts, whether you signed them or not. If he won't pay it, they'll look to you. And they'll badger whomever they think has the better chance of paying.

You'll have to write to the collection agency, certified mail, and tell them that all subsequent communications are to be in writing; no phone calls.
