Can you be taken to small claims court for a deliquent account charged off 3 1/2 yrs ago?

Yes. Charge-off is merely an internal accounting term which creditors are required to do by law. The statute of limitations for suit on a debt in Texas is 4 years.

Maybe, depends upon when the next payment after your last payment was due and you defaulted. The date of default starts the clock, not the date of charge-off.
