Legal Question in Credit and Debt Law in Texas

I wrote a credit card check to a merchant in May 2004 and was contacted on 4/11/2007 and told it was never cashed, that the company had lost it. The check was from a credit card company that has been taken over by BankOne and then by Chase Bank. I paid bills online because I worked out of town for 2 1/2 yrs. I dont remember viewing the statement for that check. I have no way to verify whether the check was paid by phone or not, I'm at a lost . The company called for the first time on 4/11 and immediately demanded payment. I told them I had to verify if what they are saying is true,since I have never received any letter from them, only this one call. What are my options? Is there a stature of limitations to merchants for holding checks uncashed. Unfortunately, I am unemployed at this time which makes matters worst. I want to protect me and my credit.

The statute of limitations on a personal check is ten (10) years from the date of the check, or three years from the date of demand for payment.

If they are the holder of that check, you are entitled to receive a copy to show that the check and claim is legitimate.
