citation served on alzhiemers patient

my dad is in a nursing home with alzhiemers he is 85yr old,my mother passed away 9-3-04 my sister and i have dual power of attorney. This is on a hospital bill that my mother had, i spoke to the creditor and explained that the ambulance service which is billed through the hospital had over charged and had to refund medicare and i wanted to make sure that the bill was correct and true. I am in the middle of aquiring records from medicare and they servered my dad this citation while i was out of town working. When i returned it was too late what can i do now and is it legal to serve a citation to and alzheimer patient.

Service is good, even if your father has Alzheimer's. If it's not too late to make answer, at least write a letter to the court stating that the allegations in the petition are denied. Send a copy to the creditor's attorney as well.

Depending upon the amount in question, you may want to hire an attorney to handle your father's defense. If judgment has been taken, and it's not too late, the attorney may be able to have the judgment set aside.
