Legal Question in Credit and Debt Law in Texas

Civil Suit to Collect a Debt

The homeowner's association for a property I no longer own is suing for past dues (property was sold in forclosure by mortgage company without them getting any money). I was served a Notice for Disclosure under Rule 194. I don't have the money or the time to participate in this lawsuit. What would happen if I just don't answer any of their requests or participate at all? I don't own any attachable assets so I don't think they could collect anything even if they get a judgment against me.

Re: Civil Suit to Collect a Debt

If you fail to answer the requests for disclosure, or any disocvery during the litigation, the otehr side can ultimately try to have a hearing to win the case or make you pay their costs for getting the answers. As a practical matter, there is not much for someone to collect if a person only has one car for everyone in the home over the age of eighteen and does not own more than one piece of real estate.
