Legal Question in Credit and Debt Law in Texas
collection of credit card debt
We have a credit card that we haven't used in years, atleast 8yrs. So, we sell our home in Louisiana and move to Texas and we tried to settle with this company representing Sears. We contacted them and they agreed to settle if we paid $ 100.00 now to hold the acct because I did not want to make a large payment without a letter advising that they agreed to the settlment. A month later the letter never came. So, we called them again and the person that agreed to the settlement (who was suppose to be a supervisor) would never call me back, but finally someone else did and adv that they never agreed to a settlement offer and that they wanted a minimum of $ 100.00 a month. Well we didn't have it, so we never paid it. I was told that in state of TX they couldn't collect after 4 yrs. So does that mean that they can't file anykind of judgement or they just can't contact me to pay it? Also, does this mean 4 yrs from the date that we used the card last or from the date of the last activity on the acct which would have been the payment at the end of 04 or beginning of 05- can't remember. Should this still be on our credit bureau and elgibile for collections? Did I mess up when I made that payment by restarting the # of yrs?

Statute of limitations is extended by any payment..even $1...so you extended to last date...
