Legal Question in Credit and Debt Law in Texas

Collection harassment for wrong person.

Constant verbal and mail harrasment to collect a medical bill for 27 year old son of ours. Mother was not there during admission or any part of stay. Supposidly listed as emergency contact only. I have wriiten several letters and numerouse phone calls demanding cease and desist to no avail. They refuse to provide any proof of why they think Mother is liable. She has no liabilty, never discussed anything with any hospitol staff prior to or during admission and proceedures. They dont even have her soc sec number yet they are relentless. We strongly feel a suit against the hospitol and the collection firm is needed to end the harassment and hopefully reform collection practices.

Any suggestions would be appreciated.

Re: Collection harassment for wrong person.

The letters have to go by certified mail. In them you have to state that you dispute the debt, demand proof of liability, and state that all subsequent communications are to be in writing. This should work for the collection agency, but is not binding upon the hospital (original creditor).

You may have to hire a lawyer to get the hospital to leave you alone.
