Collection Judgment

The family has a 2000 judgment from an unsecured credit card. The title company won't grant title insurance until it's paid. She submitted this to them (tlo2.tlc.state.tx.us/statutes/docs/PR/content/htm/pr.005.00.000052.00.htm#52.0012.00). She plans to file it to provide a release in order to sell her home prior to foreclosure. However, the collection agency has now served her with Productions of Documents a/c/t Rule 621A of the Texas Rules of Civil Procedure. Is the lien release sufficient to release the judgment? Does she need to produce anything for the collection agency's request?

if you had a lawyer, he may suggest to the Title Company that they escrow the funds..if it is a homestead as the family has homestead free funds for at least 6 months..and/or file declaratory judgment..etc..all is expensive..

You need a lawyer. Whoever is doing this is not doing it right. The house is going to be lost to foreclosure. Find a lawyer now.
