Legal Question in Credit and Debt Law in Texas
Collection
I was laid-off last year. My severance and unemployment has run out. For the last six months, I have been making payments (less than the minimum amount) on my credit card. The company has cashed all my checks, but has refused to work with me on working out a suitable repayment schedule. The company has not turned my account over to a collection agency. The collection agency contacted me and said they were going to fill a judgment against me. What are my rights?

Re: Collection
A collection agency can't "file a judgment" against you. They may turn the account over to an attorney who will file a lawsuit against you and get judgment for the unpaid balance of your account.
If you believe the balance is incorrect, you may dispute it. But do it in writing, not just over the phone.
