Legal Question in Credit and Debt Law in Texas
Collection by State of California
The State of California is trying to collect state income tax from 1988. My ex-husband filed these taxes in August of 1996, more than a year after we had divorced. My ex-husband made payments to the state from 7/14/97 to 9/01/99. The State of California is now trying to collect $27,756.00 from me. They have liened my bank account and threatened garnisheement. My question is: can the State of California garnishee my wages in Texas for California state income tax?

Re: Collection by State of California
I don't believe they have the authority to garnishee your current wages.
I'd also have serious questions whether they had the authority to lien your account. Were you given notice of a lawsuit by California? Or the entry of a California judgment in Texas?
It may well be worth your while to engage a lawyer to look into the situation.
