Legal Question in Credit and Debt Law in Texas

Company out of Business

We bought a water filter system in September 2004. The filters are supposed to be replaced once a year. When November of 2005 rolled around and we did not hear from the company, I called only to find out they went out of business. Is there a way to get out of the finance contract if the company we bought the system from is out of business an no longer holding up their end of the contract?

Re: Company out of Business

Probably not, since the note financing the purchase is with the lender and not the seller. If the replacement filter is a substantial portion of the charge, you may want to contact the Texas attorney general's office, consumer fraud division.
