Legal Question in Credit and Debt Law in Texas

'Hello, I have been contacted from a collection agency about an old credit card account my husband had gotten for me back in March of 05,we seperated almost right after that and neither one of us paid for it so now they have been calling me..... yesterday i spoke to them and offer to pay 1500.oo on it, the total balance is 8000.00 and they dropped it down to 3000.00, but then after i gave them my credit card info I regret it and just hung up and then i cancelled my card so today they called me telling me they were going to sue me for non payment and sue me for giving them fraudelent information....im really really worried and scared, can they do that, they had all my information and my ex husbands info too.....Please reply'.

I would like to help but I am not sure I understand what you have written. How did the balance on the card reach $8000? You said that neither you nor your ex-husband "paid for it" - paid for what, the card? Something charged on the card? Do you know whether or not your husband was jointly liable with you for purchases made with the card? Did you husband give you the bank agreement governing use of the card?

Don't pay anyone anything unless and until you know, for certain, what you're doing. You sound, right now, like you don't have a clue! I don't mean to sound harsh, I'm just trying to catch your attention before you throw your money away. Don't worry about their threats either - they're just trying to scare you into paying them money that you might not owe. Do collection agencies do these things? YES! Every day. All the time. People just don't know what to believe and they take advantage of that fact.

Since they dropped the debt down to $3000 from $8000, this sounds very fishy to me. Its probably a company that buys up bad debt (unpaid accounts) from other companies who have already "written the debt off" in their accounting. So, they sell the debt to certain collection companies who then try to make a buck off of the old debt by harrassing, confusing and intimidating people. This sounds like what is happening to you right now.
