Legal Question in Credit and Debt Law in Texas
I was contacted by a collection agency and told that if I don not pay they would send my account to the IRS as a 1099C. I live in Texas and wonder if they can do this or is it a scare tactic. The debt is from 2002

Technically, they can do this, but you shouldn't worry about it.
And stop talking to these people. Just hang up the phone. Telephone bill collectors have no souls.
The statute of limitations to sue on a debt is four years; I assume that it's been four years or more since you made any payments. This means that if they sue you, you would claim protection under the statute of limitations.
