Legal Question in Credit and Debt Law in Texas

contractual law?

In 1999 my wife rented an apartment while I was active duty AF. The leasing agent wrote both my wifes and my name on the lease yet I didnt sign it due to the fact I was not present or reside there. The lease was broken due a permanent change of station. Now the lease termination charges are in collections and are on my credit. I understand that I own this debt due to community property laws, but does this belong on my credit. I feel I cant break a contract that I did not sign.

Re: contractual law?

Unfortunately, your wife has the authority to bind the both of you on most contracts. So long as you are on active duty, or may be assigned to another duty station, whoever is responsible for the lease should make sure that the lease may be ended without penalty if your duty station is changed.

That's not standard on a lease but can be written into the lease. If the landlord won't accept that, find another who will.
