Legal Question in Credit and Debt Law in Texas

Credit Card Company Abusing Power

This question might sound trivial but I am extremely pissed off at the Bank of America Credit Card Co. A female employee called me on the 26th or 27th of December asking if I could make a 40.00 payment before or on the 31st so that I wouldn't incur any 90 day delinquency charges on my credit card since I am over my limit. I specifically told her that the money was not available in my Wellsfargo checking account and that I'd ask my parents for the funds. On the 31st of December, I made a 50.00 payment to the card company, but from my mother's checking account. Today is January 5, 2009 and Wellsfargo sent me an email saying that my checking account was overdrawn although I don't have any automatic bill pay set up and haven't spent anymore money. I investigated and 40.00 had been debited from my account causing me to be overdrawn by 73.05 because of an added 35.00 overdraft fee. The employee authorized the payment without my consent which is infuriating. Is it worth it?

Go to Wells Fargo and ask the overdrafts be removed....and if not, move your account. Go to small claims costs $100..or so..but you can do much by phone if you can reach officers..but a personal visit is best..Be pleasant but firm...
