Legal Question in Credit and Debt Law in Texas

Credit Card Debt after Death

My uncle died with no assets except a small house he inherited from my grandmother. He doesn't know his son well..didn't pay child support. My parents have been taking care of him during his bout with cancer, and he left them his house, which is not in good condition. We found out he had 12,000 in credit card debt. I have no idea how he could have been given that much credit...My question is this. Will my parents be saddled with this debt? I'm not sure the house is even sellable in this market, and it will take a lot of repairs on my dad's part to make it sellable. If he could sell it, he was going to split the leftover (after deducting federal income tax, property tax, cost of repairs, etc.) with my uncle's son and me. It may not be worth the trouble if 12,000 will go to the credit card company. Any advice?

Re: Credit Card Debt after Death

contact a probate lawyer or call us..but the credit card company has to apply to Probate Court to be paid..and it's claim may be denied...but if the house has any value without repair, perhaps it could be sold. But no one is responsible for the credit card debts and they could be claimed only thru probate court...so see a lawyer or call..
