Legal Question in Credit and Debt Law in Texas

credit card debt

My husband passed away 2 years ago and there were several credit card debts that I'm unable to pay.

Our home was homesteded and the house was in both our names but since his name has been removed from the deed. The taxes that I have paid show the house to be in my name only. Since then I was told that they can not put a judgement on my home. I have heard of a default judgement and am not sure what that is. Is there any way that the companies can prevent me from selling the house oweing the credit card companies money. The will that we had at the time of my husband's passing has been probated. I plan on selling the house and moving to another house that is smaller and will better for myself later on in life. I have thought about trying to pay what is owed or at least a percentage of balance on cards but at this time I'm on a fixed income and am unable to pay amount due each month. Not sure what to do at this point or what I can do. Any advice you can give would be appreciated. Thank You

Re: credit card debt

If the debt is only in your husband's name, you should not pay..if it was a joint card, you may have to pay. It does not cost much to visit a lawyer experienced in collections..and credit..but general questions are hard to answer..Even so, unless there are judgments against you, debts do not affect what you are paid at closing on a sale of your home.
