Legal Question in Credit and Debt Law in Texas
Credit Card Debt- Multiple Collectors
I have a credit card that I was unable to make payments on for minimum and they refuse to work with me on an amount that I CAN pay so I just let it go. Dec 2007 got statement saying was now in collections from one company, in March 08 got several calls from another company and told them to send a statement. They did send a statement for the same card but they are a new collections company and they show a higher (ALOT) balance. Today got a call from a 3rd company saying for the same card, told them to send a statement. What is going on, how can 3 collections companies collect on same card and for different amounts. Is there a way to get them to work with me on payment I can do? And how do I know what company to call of the three? Please help. Also this is a personal card, can they go after business that is a PA? What can they do to me personally or to business?

Re: Credit Card Debt- Multiple Collectors
Based on what you have stated, collection agencies buy past due accounts for a discounted rate and then attempt to collect the full amount plus other fees, interest, and penalties. Generally, personal debts can not be collected through business assets, but this ultimately depends upon how your business is formed. Additionally, there are specifc laws (both federal and state) which govern the behavior and actions of collections agencies.
