Legal Question in Credit and Debt Law in Texas

credit card debt

We received a letter stating that a collection agency(Asset Acceptance) tell us that we have a court date. I have 2 questions, 1. My husband hasn't worked since 2004 I work cleaning offices at night and only make enough to barely pay the bills and support 3 kids, we don't ouwn a house any more what can they take from us?

2. because the credit card is in my husbands name and the paper work only lists him can they touch the money that I make?

Creditors cannot touch your earnings..but if they get a judgment they can go to Court to garnish bank accounts or to take nonexempt property...not your home or furniture...nor car..unless you have two..etc...but it sounds like you were not served papers..as the Court tells you when you have a court date, not the collection agency..I wouold like to see that letter as it could be a real violation of the law...
