Legal Question in Credit and Debt Law in Texas
credit card debt in texas
My ex-husband was awarded one of our credit cards through our divorce, I have handled all the debt, I was awarded, but he chose not to pay anything on this debt. He has recently passed away and they are calling me for the debt. The divorce decree states it's his debt and he agreeded to accept full responsibility. Can any type of judgement be placed on me in the State of Texas and can they collect from me? The letter is now coming from Law offices of Mitchell N Kay.P.C, which has a horrible reputation for harrassing people.

The divorce decree is enforceable between you and your husband (and his estate); but not against third parties, such as credit card companies. If you were originally liable on the debt, then you may still be. If you have to pay on the debt, then you can look to his estate for reimbursement, under the terms of the decree.
