Legal Question in Credit and Debt Law in Texas

credit card debt

my ex wife charged up a sears card at the time of our divorce. i agreed to pay amount. amount i was paying was not putting a dent in the balace. missed a few payments and went to collections. i agreed to pay collections on automatic draft. they collected 3 payments sold account to another collection agency. they wanted a new set of fees i told them i would only pay original agreement they would not agree to that. they sold account to another agency. i made agreement with them. they took out 3 payments from automatic draft and then sold acount to another agency. made agreement to make payments with automatic draft they did not collect on any payments instead they now are going to sue for a judgement. this time frame is from 1999 to present. the original amount was 900.00 they want 3000.00 plus fees, court cost, past intrest and future intrest. i am willing to pay them the debt but 600.00 has been paid and the original deal was for 1500.00 i just want to pay 900.00 and thats it. thank you for your time. bart

Re: credit card debt

Sorry, Bart. Each time you made payment re-set the clock for the statute of limitations. Moreover, the contract you signed gave them the right to arbitrarily change the interest rate under circumstances of default.

When a lawyer is on the scene you may be able to negotiate a compromise and settlement.
