Legal Question in Credit and Debt Law in Texas

Credit Card Issued to Minor

My son [16] signed up for a credit card; however, he used a ''false'' birthdate, but his real Social Security Number. He application was accepted, and he proceeded to spend nearly $500.00 on the card.

My question is, is he bound to his debts? Am I?

I read somewhere that according to business law, the debts must be written off by the creditor provided that the minor terminates the contract prior to reaching the age of majority.

Re: Credit Card Issued to Minor

You should not be responsible for his debt, except for the fact that he has committed a crime in securing that credit card. Giving a false birth date means that he's incurred the debt by fraud on the credit card company. That voids the minor safe haven set out in business law.
