Credit Card Judgements

I have not paid my credit card bill in 90 days. Not from a lack of trying but because the amount I can send in is not as much as the debt collector requires. Now, they say a judgement will be placed upon me. I do not own a home and my cars are financed. I do not work but my husband does. Should I continue sending them money even if it is not as much as they want? What will a judgement do?

When you say debt collector, are you referring to a collection agency or the creditor to whom the debt is directly owed? I would strongly advise you not to deal with a collection agency under any set of circumstances. You are not required by law to deal with a collection agency - you may send them a letter telling them to cease and desist from all communications with you - that you prefer to deal with the original creditor. By law, they are required to stop communicating with you.

In order to obtain a judgment against you, they must first file a lawsuit and then serve you personally with the papers. If you have no assets, there is nothing for them to collect.
