Legal Question in Credit and Debt Law in Texas

Credit Card Lawsuit (Capital One)

I am being sued for an unpaid balance owed on the credit card. I do owe the balance, but is unable to pay. Do I have to show up in court? What happens if judgment is against me and I do not pay? Can my wages be garnished?

If you do not show up, (or file an answer), then the creditor can take a default judgment against you. The judgment would allow them to reach your non-exempt assets, including your bank account. They cannot garnish your wages in Texas.
