Legal Question in Credit and Debt Law in Texas

credit card co. suing individual for balance

How do I defend against a credit card co. suing for the balance. I always had good credit, but I got into business for

myself, and I used the credit card to try to help myself, while I could recuperate financially. I haven't filed bankruptcy, and don't want to. I just need more time to recuperate. There is no guarantee that I will recuperate, but

I sure am going to keep trying. I haven't made any payments,

and I finally got my home payed off. But I don't want to get

an equity loan. This is an unsecured credit card debt. I just

got notice from the county and from them saying their intentions to sue. I really don't mind if they put a lien on my property, but is that all they can do? How can I defend myself? I really have no extra money to hire lawyers, etc.

Re: credit card co. suing individual for balance

I would advise you to start making payments. Even if the payments are only $20 month.

A judgment for an unsecured credit card cannot be used to place a lien on your homestead.
