Legal Question in Credit and Debt Law in Texas

Credit Cards and Depts

My husband says whats his is his and mine is mine. He has bank accounts and credit cards in his name only. He says its none of my business. How can companies not allow the spouse access to this info? If there was a divorce, they are both responsible, right? What if he used the card to go buy personal items, trips or whatever and took trips without other spouses knowledge. How does all this work in legal terms. If I helped him get ahead financialy and I'm the one who has the lower paying job, (I have credit problems in the past from a divorce and also trying to be nice and help family members ect.) He has had the same, but also a repo which I've never had. He has managed to get credit cards. I assume because of greater income and the money he puts into account. Can I legally fill out application in his name and include me, we each get a card? He will not get extra card for me with his credit cards because of how he thinks money should be dispersed. He thinks 50/50 on paying bills ect. His money his. My money mine. And we pay bills from the money we make ourselves. So why is it supposely 50/50 to pay off debts. And he's the only one with cash in the bank and credit cards? I don't have access to any of this.

Re: Credit Cards and Depts

The courts have no authority over an ongoing marriage relationship. (unless there is some criminal fraud). You cannot sign his name to a credit application. In the event of another divorce, then the court will look at the equities and ALL assets and debts of the marriage will be community debts and assets, subject to division between you.

Private companies and banks are under no obligation to share information with you, if you are not a party to their transaction.

Unfortunately you did not address this issue prior to marriage, but you should attend some financial/marriage counseling immediately. Marriage problems and divorces are very often tied to financial issues.
